Nature of Section 376 IPC
The violation of Section 375, which carries a sentence under Section 376 of the IPC, is a cognizable offense. A cognizable offense is one for which, in accordance with the first schedule or any other applicable law, a police officer may make an arrest without a warrant and launch an investigation without the judge's approval. Examples of cognizable offenses include murder, rape, kidnapping, theft, dowry death, and other heinous or serious crimes.
